Terms of Use

The terms that apply when you use this website or request a quote from us.

These Terms of Use govern access to and use of titaniumfreight.com (the "site"), operated by Titanium Freight Inc, a California corporation with its principal office at 3385 Hollowell Dr, Ceres, California 95307. By using the site you agree to these terms. If you do not agree, do not use the site.

We are a broker, not a motor carrier. Titanium Freight Inc is licensed by the Federal Motor Carrier Safety Administration as a broker of property (MC 90818689 / USDOT 7254083). We source capacity from, and arrange for the transportation of freight by, independent motor carriers. We own no tractors, trailers or chassis, we employ no drivers, and we do not take physical possession of freight. The motor carrier selected for a shipment performs the transportation and is responsible for the cargo in its custody under its own operating authority and insurance.

1. Use of the site

You may use the site for legitimate business purposes relating to freight transportation services. You agree not to use the site to transmit unlawful, misleading or harmful content, to interfere with its operation or security, to attempt unauthorised access to any system, or to collect information from the site by automated means without our prior written consent.

2. Quotes, rates and capacity

Rate quotations provided through this site or by our team are estimates based on the information supplied and on market conditions at the time of quoting. Unless expressly agreed in writing, a quotation is not a binding contract, is valid only for the shipment and time period described, and is subject to equipment availability at tender. Rates may change if the actual shipment differs from the information provided, including changes to weight, dimensions, commodity, accessorial requirements, pickup or delivery dates, or facility conditions. Accessorial charges such as detention, layover, truck ordered not used, lumper fees, reconsignment and storage may apply and will be passed through with supporting documentation.

3. Services are governed by our written agreements

Freight services are provided under the terms of our shipper agreement, broker-carrier agreement, credit application, rate confirmation and applicable bill of lading, as relevant. Where anything in these Terms of Use conflicts with a signed agreement between you and Titanium Freight Inc, the signed agreement controls with respect to the services. Nothing on this site modifies those agreements or creates a transportation contract on its own.

4. Cargo claims and liability

Claims for loss of or damage to cargo are made against the motor carrier that transported the freight, under the carrier's liability and its cargo insurance, and are subject to the notice and filing periods that apply to that carrier and shipment. We will assist in presenting and pursuing a claim and will provide the documentation in our possession. Any contingent cargo coverage maintained by Titanium Freight Inc responds only in accordance with its own policy terms, conditions and limits. It is excess and conditional, it is not a guarantee of payment, and it is not a substitute for carrier insurance or for a shipper's own cargo insurance. Nothing on this site constitutes an offer, binder or certificate of insurance.

5. Cross-border shipments

For freight moving between the United States and Canada or Mexico, customs clearance, duties, taxes and import or export compliance are the responsibility of the shipper, the importer or exporter of record and their appointed customs broker, unless we have agreed otherwise in writing. Titanium Freight Inc is not a customs broker and does not provide customs brokerage, classification or duty advice. Transit times on cross-border lanes are estimates and do not account for inspection, clearance delays or border wait times. Carrier liability and insurance terms may differ outside the United States, and some cargo policies limit or exclude coverage in Mexico. Confirm the coverage that applies to your shipment before tendering it.

6. No warranties

The site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, secure or error free, that defects will be corrected, or that the content is complete, current or accurate. Transit times, coverage descriptions and capacity statements on this site are general information, not guarantees of performance on any particular shipment.

7. Limitation of liability

To the fullest extent permitted by law, Titanium Freight Inc and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, loss of business, loss of goodwill or loss of data, arising out of or relating to your use of this site, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility of such damages. Our aggregate liability arising out of or relating to your use of the site will not exceed one hundred U.S. dollars (USD 100). This section does not limit liability that cannot be limited under applicable law, and it does not apply to our obligations under a signed transportation services agreement, which are governed by that agreement.

8. Intellectual property

The site and its contents, including text, graphics, logos, the Titanium Freight name and marks, layout and design, are owned by or licensed to Titanium Freight Inc and are protected by intellectual property laws. You may view, download and print pages for your own internal business use in evaluating or using our services. You may not otherwise reproduce, distribute, modify, frame or create derivative works from the site without our prior written permission.

9. Third-party links

The site may contain links to third-party websites, including carrier, regulator, payment and tracking resources. Those sites are not under our control. We provide the links for convenience only and are not responsible for their content, availability, security or practices. A link does not imply endorsement.

10. Submissions and communications

Information you submit through the site, such as a quote request, is handled as described in our Privacy Policy. Do not submit confidential information you do not wish us to hold, and do not submit payment card numbers or government identification numbers through the site forms. You consent to receive communications from us electronically in connection with any enquiry you submit.

11. Indemnity

You agree to indemnify and hold harmless Titanium Freight Inc and its officers, directors, employees and agents from any claim, demand, loss or expense, including reasonable legal fees, arising out of your misuse of the site, your breach of these terms, or your violation of any law or the rights of a third party.

12. Governing law and venue

These Terms of Use are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to the site or these terms will be brought exclusively in the state or federal courts located in Stanislaus County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section affects any dispute resolution provision contained in a signed transportation services agreement, which controls for disputes about services. Claims governed by federal transportation law remain subject to that law.

13. Changes and severability

We may revise these Terms of Use at any time by posting an updated version with a new "last updated" date. Continued use of the site after an update constitutes acceptance of the revised terms. If any provision is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver of it.
